Chief Justice Directs Election Commission to Ensure Transparent Delimitations

In a significant move, Chief Justice of Pakistan (CJP) Umar Ata Bandial has stressed the importance of conducting constituency delimitations with utmost transparency by the Election Commission of Pakistan (ECP). The call for transparency came during CJP Bandial's leadership over a two-member bench, which was convened to address petitions pertaining to the delimitation of provincial constituencies PS 7, 8, and 9 in Shikarpur. These constituencies had been subjects of contention since 2018 and were brought before the apex court.

Chief Justice Bandial underscored that the delimitation process holds immense public interest and has been a recurring topic of discussion within the highest echelons of the court. He stated, "The Election Commission should make certain that the delimitation proceedings are conducted in a transparent manner." He further elucidated the potential impact of even a minor alteration in the geographical boundaries, noting that such changes, often made by the 'tapedar' (land record officer), can significantly sway the number of votes a candidate garners.

A point of inquiry raised by CJP Bandial revolved around the schedule for the impending general elections. In response, Director General (Law) Muhammad Arshad expressed uncertainty, stating, "Currently, there is no fixed date for the elections. The election commission must address all concerns before the polling commences," highlighting the need for comprehensive preparation.

The Chief Justice went on to emphasize the sensitivity of this issue in Sindh, where persistent grievances have arisen regarding the accuracy of the delimitation process within the province. This acknowledgment of regional concerns underscores the commitment to a fair and unbiased process across all territories.

Following the exchange of arguments, the Supreme Court, taking cognizance of the complexities involved, has referred the matter back to the Election Commission for further deliberation. This decision signifies the court's dedication to ensuring that the electoral process adheres to the principles of transparency, equity, and the safeguarding of democratic values.

As Pakistan approaches a critical juncture in its democratic journey, the role of the Election Commission in overseeing the delimitation process becomes paramount. The expectations set by Chief Justice Bandial, coupled with the apex court's engagement, establish a precedent for accountable governance and just electoral practices.

In conclusion, the call for transparent delimitations by Chief Justice Umar Ata Bandial serves as a testament to the commitment of Pakistan's judiciary to uphold democratic integrity. As the Election Commission addresses these concerns, the nation watches with anticipation, hopeful for a fair and credible electoral system that truly represents the will of the people.
